TWO MEN SENTENCED ON FEDERAL DRUG CHARGES
Two out-of-state men charged in connection with a Beaver Dam drug operation
have been sentenced to federal prison.
Rogelio Aguiar, 25, of Zilah, Wash., and Alvino M. Rodriguez-Morales, 34,
of Danville, Ill., were sentenced Tuesday in U.S. District Court in
Owensboro for conspiracy to possess with the intent to distribute more than
100 kilograms of marijuana and possession with the intent to distribute 75
kilograms of marijuana, respectively.
Judge Joseph H. McKinley sentenced Aguiar to 46 months in prison, plus four
years of supervised release following incarceration. Rodriquez-Morales was
sentenced to 70 months in prison, followed by four years of supervised release.
There is no parole in the federal judicial system.
Aguiar and Rodriquez-Morales pleaded guilty to the charges, which arose as
a result of a joint federal, state and local investigation into the
interstate drug trafficking activity of Lynn Jay Fredell and his
associates. The investigation found that Rodriquez-Morales and Aguiar were
the drug source for Fredell.
On May 25, 2000, the FBI recovered about 75 kilograms of marijuana and two
pounds of methamphetamine at a garage owned by Fredell next to his
residence at 420 W. Seventh St., Beaver Dam. Scales, drug paraphernalia,
cash and several vehicles were seized.
Fredell was found guilty by a jury in August on multiple drug charges and
is scheduled to be sentenced Dec. 14
Also Tuesday, Stephen B. Pence, U.S. attorney for the western district of
Kentucky, announced that Terry Joe Burden, 31, of Hartford was sentenced in
federal district court for knowingly making a false material declaration.
McKinley sentenced Burden to five years probation and a year of home
incarceration.
Burden pleaded guilty to signing a federal court affidavit in which he
falsely claimed possession of a handgun found on the premises of Fredell, a
convicted felon and co-defendant in the criminal case.
In an unrelated sentencing Monday, McKinley sentenced Grover Clifton
Gabbard, 32, of Island to 48 months in prison, followed by three years of
supervised release, for being a felon in possession of a gun.
Gabbard pleaded guilty to the charge March 7.
