PHARMACY OWNER'S BAIL IN QUESTION

A Texarkana pharmacy owner is expected to be back in court to show why her
bail should not be revoked because of failed drug tests.

U.S. Magistrate Judge Caroline Craven on April 22 signed a petition by U.S.
Pretrial Services Officer Michael E. Carr that set in motion a hearing for
May 9 in the case of Vickey Hinton Donnelly.

Federal authorties have indicated they want her bail revoked. Donnelly is
currently free on a $10,000 bond.

David James, Donnelly's lawyer said, "We certainly plan to be at the
hearing and assert her rights."

James said he still has to "explore the facts" of the new allegations
against Donnelly.

Donnelly, 49, is the owner of Summerhill Pharmacy in Texarkana, Texas. She
is charged with conspiracy to sell prescription drug samples and selling
prescription drug samples. The case is being heard in federal district
court in Texarkana, Texas.

Donnelly, according to the petition, submitted on March 11 a routine urine
sample as part of the conditions of her release on a $10,000 bail bond. The
sample tested positive for Hydromorphone and Hydrocodone.

"When confronted regarding the positive result on April 1, 2002, the
defendant said she forgot that she had taken a Lortab or Vicodin for a
headache a few days before the drug test. On April 2, 2002, the defendant
told the supervision officer that she had taken Tussionex for a cough,"
according to the court document.

Donnelly, according to the report submitted a second urine sample on April
2, which also tested positive for Hydromorphone and Hydrocodone. Also on
that day, Donnelly signed a release of information for Tussionex prescribed
by Dr. Charles Hollingsworth and for Adipex-P, prescribed by Dr. Terry Davis.

"Dr. Charles Hollingsworth told the supervision officer on April 3, 2002,
that he had not prescribed Tussionex for the defendant," according to the
report.

Federal officials learned that Dr. Davis had been retired for two years.

"On April 9, 2002, the defendant submitted for inspection to the
supervision officer prescriptions by Dr. Charles Marrow for Adipex-P,
Estratest and Xenical. She refused to sign a release of information to send
to Dr. Charles Marrow," according to the court documents.

Attempts to contact Dr. Marrow were unsuccessful on Wednesday.
