WARREN MOTHER GETS NEW CHARGES IN HEROIN CASE
She Faces 10 Penalties After Plea Withdrawal
A Warren woman charged with injecting heroin into her teenage daughter's
friend faces 10 additional drug-related charges, Macomb County prosecutors
said Thursday.
Among the new charges: providing heroin to her 15-year-old daughter and to
a 16-year-old boy.
County prosecutors added the charges against Lisa Marie Havens, 45, after
she withdrew a guilty plea on April 16. County officials had agreed to only
charge her with four counts of providing narcotics to her daughter's
14-year-old friend if Havens pleaded guilty, said county Prosecutor Carl
Marlinga.
"We thought upon the original guilty plea, she would get the appropriate
sentence," Marlinga said.
But instead of entering a plea before Macomb County Circuit Judge Mary
Chrzanowski, Havens withdrew it after the judge said she planned to
sentence Havens to 15 years in prison.
Chrzanowski's proposed punishment was more than what state sentencing
guidelines call for -- that Havens receive a maximum 23-month sentence. But
a state law says a judge can add to that sentence if there is a
"substantial and compelling reason," which Chrzanowski said she found.
Havens now faces three counts of recruiting a minor to deliver heroin -- a
maximum 20-year felony; three counts of delivering heroin to her daughter
- -- a maximum 20-year felony; another three counts of delivering heroin to a
16-year-old boy, and one count of maintaining a drug house, a two-year
misdemeanor. The original four counts of providing narcotics to her
daughter's friend carry a minimum of one year on each count and a maximum
of 40 years.
"It was a vicious criminal act," Marlinga said.
Havens' lawyer, Mark Cardellio, said the prosecutor is infringing on
Havens' rights.
"We'll see how the court of appeals feels that new charges were added
because she decided to exercise her constitutional right to a new trial,"
he said.
Assistant Prosecutor David Portuesi said he expects Havens to be arraigned
on the new charges early next week.
