ABBOTSFORD POLICE BILLS LANDLORD

The Abbotsford Police Department has submitted the first invoice under a
City by-law adopted January 28, 2002, seeking recovery of "extraordinary"
costs associated to a marijuana grow operation.

On January 28, Abbotsford City Counsel adopted by-law 1079-2001, the
"Abbotsford Controlled Substance Property By-law" which provides a
mechanism by which the Abbotsford Police Department can bill landlords or
the occupants of a self-owned premises for extraordinary costs incurred for
dismantling a grow operation.

Extraordinary costs, as outlined in the by-law, can be further defined as
"works and services consisting of dismantling, disassembly, clean up,
transportation, storage and disposal of equipment, substances and materials
and other paraphernalia associated with such trade, business or manufacture".

While occupants are liable for costs subsequent to the first incident,
landlords who are not occupants of the same property, will only incur costs
as a result of a second offence regardless of where that rental property
may be within the City of Abbotsford.

In this first case officers dismantled a grow operations at a residence in
the 3100-block of Babich Street on February 7, 2001 and again on June 26,
2002. In both cases, investigators not only seized marijuana but also
apparatus associated to a grow operation. The landlord was identified and
will be receiving an invoice for approximately $1,300, to cover the
extraordinary costs, including any overtime incurred by the Abbotsford
Police Department.
