CU FOOTBALL PLAYER WON'T FACE DRUG CHARGES TIED TO PARTY
BOULDER - Prosecutors have exonerated University of Colorado wide receiver
Ron Monteilh of supplying marijuana to high school recruits during a party
that spawned charges against four football players.
Prosecutor Pete Maguire filed a motion to dismiss two felony charges
against Monteilh.
"We believe he was misidentified," Maguire said Friday.
District Judge Morris W. Sandstead hasn't ruled on the motion, which was
filed Thursday.
"It feels good, but at the same time there's only so much that can be done
for my name," Monteilh said.
Stephan Wall, Monteilh's lawyer, said he expected the move. "My feeling is
that they could have or should have done this a long time ago, but I'm not
going to say anything bad about the DA."
Monteilh and teammates Marques Harris, Corey Alexander and Allen Mackey
were charged with contributing to the delinquency of minors by providing
alcohol and marijuana during an off-campus party for recruits in December.
Harris and Alexander, both 20, received 18-month deferred sentences last
week after pleading guilty to providing alcohol to minors.
The arraignment of Mackey, 20, was postponed Friday after his attorney and
the prosecutor requested more time to discuss a plea agreement.
Mackey is expected to plead guilty when he returns to court Sept. 10.
In July, CU's Office of Judicial Affairs cleared Monteilh of violating the
student code in connection with the off-campus party.
CU hasn't released the names of seven students who were sanctioned for
their actions at the party.
CU and Boulder police began investigating the players and others after a
woman at the party said she was raped. No rape charges were filed, however.
CU police Sgt. Tim McGraw said the investigation is complete.
Meanwhile, CU police have issued a summons to cornerback Clyde Surrell,
charging the 20-year-old with possession of less than an ounce of
marijuana, a petty offense.
It was not immediately clear whether the charge stemmed from the December
party.
Surrell, who was suspended from CU last spring for violating dormitory
rules, could not be reached for comment.
