COURT ADJOURNED ON POT PLANT SEIZURE CASE
Medical marijuana licencee Brian Carlisle was denied an interim order to
provide him with a supply of marijuana pending a ruling of his application
for restitution for 51 pot plants seized by police nearly two years ago.
A hearing in B.C. Supreme Court yesterday was adjourned because of court
schedules to June 5 when lawyers for the Crown and defense will make
submissions on the matter.
Mr. Carlisle says he is seeking restitution for the $90,000 he was forced
to spend buying marijuana after his plants were seized in July, 2001. He
is also seeking $10,000 in punitive damages.
In September 2001, Mr. Carlisle was granted a licence to grow
marijuana for medical purposes, and charges of marijuana cultivation and
trafficking against him were stayed.
The seized pot plants were returned in a decomposed state to the plaintiff
by a court order in January this year.
