LEGAL DISPUTES SURROUNDING ROSENTHAL MISUNDERSTOOD
U.S. District Judge Charles Breyer Did Not Make Ed Rosenthal A Felon.
Rosenthal is a felon because he and his lawyer, Dennis Riordan, did not
file a motion to dismiss claiming that Rosenthal's fundamental rights to
life, liberty and property protected by the Fourth, Fifth and Fourteenth
Amendments have been violated by the enforcement of the federal marijuana laws.
Under due process of law, the violation of fundamental rights requires a
compelling state interest. Rosenthal did not claim that marijuana is safe
to use under medical supervision and is arbitrarily classified as a
controlled substance violating due process of law.
Rosenthal did not ask Breyer to declare the federal classification of
marijuana as a controlled substance unconstitutional.
