FBI CONDUCTING CIVIL RIGHTS INVESTIGATION OF FATAL SHOOTING OF TEEN BY
LOUISVILLE POLICE

LOUISVILLE, Ky. -- Federal officials are investigating the death of a black
teenager shot three times in the back last week by a Louisville police
officer, an FBI spokesman said Tuesday.

Officer McKenzie Mattingly, working undercover, shot Michael Newby in the
back Saturday night after they struggled for Mattingly's service handgun,
Police Chief Robert White said. Mattingly was trying to buy drugs from
Newby when the deal went wrong, White said.

Newby, 19, was carrying a handgun, White said. Also, a powdered substance,
either cocaine or crack cocaine, was found on him after the shooting.

Mattingly has declined to talk to police investigators and invoked his
right against self-incrimination, White said. He has been placed on paid
administrative leave.

"We're looking at the facts of the case to determine whether the man's
civil rights were violated," said David Beyer, an FBI spokesman in
Louisville. He said he could not predict how long the FBI investigation
would take, but said it would have no bearing on the local prosecutor's case.

Helen Swain, Newby's aunt, who has been speaking for the family, said she
is frustrated with the case but declined to comment further.
