Stepbrother Found Guilty Of Manslaughter

Joseph Worrall unlawfully killed his stepbrother with a lethal dose of
heroin although the victim consented to the injection, a judge ruled
Friday. Justice David Watt found Worrall, 29, guilty of manslaughter in the
Jan. 2, 2000 death of Brendan Carlin, 24, an accomplished chef at Sambuca
restaurant. Watt will sentence Worrall April 30.

"Although the victim consented to the injection of heroin, the supplier
still has committed an unlawful act leading to death," prosecutor Calvin
Barry said.

"This case should serve as a warning to those supplying drugs: We are
coming after you if you give drugs that cause death. It's not death by drug
misadventure," Barry said.

Dangerous Drug

"Heroin is a very dangerous drug. The deceased was injected with the lower
end of the lethal range of the drug, but that too can prove fatal."

Defence lawyer Paul Copeland argued Carlin died of Ecstasy and that
pathologist Dr. David Chiasson rushed to find evidence backing the police
theory that heroin killed Carlin.

Barry said on the night of Jan. 1, 2000 and into the morning of Jan. 2,
Worrall and his stepbrother went to the Queen St. W. home of Nguyen To, an
acquaintance of Worrall.

Barry said Worrall prepared a syringe with heroin for himself while Carlin
stayed outside.

He said Worrall gave himself heroin and made up a second syringe for
Carlin. Worrall then went outside and gave his stepbrother the second
syringe. The following afternoon, Carlin's body was found on Augusta Ave.

Barry said he will be seeking a custodial sentence.
