Some lawyers are challenging the "drugged driver" law, which took
effect Dec. 19, 2003. According to this law, any detectable amount of
drugs such as marijuana or cocaine in the bloodstream is illegal. The
lawyers are challenging the "any detectable amount" wording and are
comparing it to the alcohol law, which has a measurable percentage
specified for legal intoxication.

They are also challenging that "drug users can be penalized for the
mere use of a restricted substance even after considerable time has
passed, so long as it is allegedly detected even under what is here an
undefined standard," according to defense attorney Laurence M. Moon.

I fail to see what the debate is. Illegal drugs are illegal. If a
person has any detectable amount of illegal drugs in his or her
bloodstream, the illegal drug was ingested. The issues of when the
drug was taken and how long the drug stays in the system are
irrelevant. Again, that person took the illegal drug to begin with.

If someone driving with a detectable amount of illegal drug in his or
her system killed a loved one, would it matter to you when that
illegal drug was taken?

Let's stop enabling drug users. They make the choice to ingest the
illegal substance; therefore, they should face the consequences of
making that choice.
