MEDICAL MARIJUANA A HUMAN RIGHTS CASE

VANCOUVER - A B.C. medical marijuana user has taken his right to grow
pot in a rental home to the Human Rights Tribunal.

Vandale Smith told a landlord he intended to grow marijuana and was
licensed to do so by Health Canada.

Landlord Paramjit Tung admitted during pre-hearing applications that
he turned the man down as a tenant.

Tung says Smith had invalid references and couldn't provide a source of income.

Smith calls the refusal discrimination on the basis of physical disability.

Tung attempted to have the complaint thrown out, but a tribunal
member ruled the case should go ahead.

"If proven, this may establish a sufficient connection between Mr.
Smith's disability and the refusal to rent to establish
discrimination on the basis of physical disability," tribunal member
Lindsay Lyster wrote.

A date has been set, but the Human Rights Tribunal won't release the
information to the public.
