MEDICAL MARIJUANA ORDINANCE AMENDED
Tuesday, March 15, the Laurel City council officially appointed Heidi
Jensen as the City Planner for the City of Laurel. The Council also
appointed Jensen as the CTEP administrator and the flood plain
administrator. Voting to elect Jensen to the listed positions resulted
in three separate unanimous decisions of 8-0.
A public hearing addressed Ordinance No. O11-03. The ordinance allows
for the council to vote to adopt a technical amendment to Ordinance
No. O11-01 to resolve a typographical error in the previously adopted
ordinance. The first reading of the ordinance was March 1. The word
"dispensary" was adopted to replace the word "cultivation."
Mayor Ken Olson stated that the council had the option to suspend the
rule to wait two weeks for the second reading of the ordinance and to
place the item on the Tuesday, March 15, agenda. Council members voted
8-0 to do so.
City council members voted an 8-0 decision to adopt Ordinance No.
O11-01 with a roll call vote.
A section of Ordinance No. O11-01 was amended to read "17.08.761
Medical marijuana dispensary or dispensary."
In context, the section now reads, "Medical marijuana dispensary or
dispensary shall mean a property or structure used to sell,
distribute, transmit, give, dispense or otherwise provide marijuana in
any manner to patients or primary caregivers pursuant to the authority
contained in MCA 50-46-101 et. seq. and the implementing
administrative regulations promulgated thereto. The City shall not
license a Medical marijuana dispensary facility or dispensary facility
within one thousand feet of any private or public preschool,
elementary, secondary, vocational or trade school, any child care
center, place of worship or religious assembly, any public or private
park, pool, playground or recreational facility, any juvenile or adult
halfway house, correctional facility or substance abuse rehabilitation
center as provided in Title 5, Chapter 5.70.050."
The following ordinances and resolutions were approved:
Resolution No. R11-21: Resolution authorizing the Mayor to sign an
agreement to provide health services with St. Vincent Healthcare of
Billings. The motion carried 8-0.
Resolution No. R11-22: An intent to approve budget amendment
resolution to increase appropriations in the General Fund for
equipment for the Library and Fire Departments for fiscal year 2011.
The motion carried 8-0 to put Resolution No. R11-22 on the April 5
council agenda for public hearing.
Resolution No. R11-23: An intent to approve a budget amendment
resolution amending appropriation distribution for various funds for
fiscal year 2011. The vote carried 8-0 to put Resolution No. R11-23 on
the April 5 council agenda for public hearing.
Ordinance No. O11-04: First reading of an ordinance amending Section
12.32.050 titled "Creation and establishment of a City Tree Board" and
section 12.32.060 of the Laurel Municipal Code titled "Term of office"
located at Title 12 of the Laurel Municipal Code. The vote carried 8-0
to put Ordinance No. O11-04 on the April 5 council agenda for public
hearing.
Ordinance No. O11-05: First reading of an ordinance amending section
5.44.030 titled "Exceptions to provisions" located at Title 5 of the
Laurel Municipal Code. The vote carried 8-0 to put Ordinance No.
O11-05 on the April 5 council agenda for public hearing.
Ordinance No. O11-03: Second reading of an ordinance of the City
Council of the City of Laurel, Montana adopting a technical amendment
