WINDSOR POT SHOP MAY BE CLOSED FOR GOOD

WINDSOR -- Time is running out for Lazarus Pino and his medical
marijuana business in Windsor.

In December, Pino opened the medical marijuana dispensary at 1292
Main St. Unit 1 despite a moratorium put in place by the Windsor Town
Board.

Since that time, Pino has been in and out of court trying to fight
the town's attempts to shut him down. Last week's passing of an
appeals deadline is the last thing Windsor officials need to close
Pino permanently.

Pino had until last week to file an appeal in Weld District Court to
fight a condemnation notice upheld by the Windsor Board of Appeals.
Now that the 30-day deadline is over, Windsor Town Attorney Ian
McCargar can go to district court and ask for an injunction to shut
down the business down permanently.

"Once that 30-day clock expires, he has no other remedy," McCargar
said. "The building code enforcement side of our case is now in place."

Pino said, however, that his options are not up. He still plans to
appeal a municipal court decision to district court as soon as he can
find another attorney. Pino's attorney Daniel Taylor, of Wheat Ridge,
asked to be removed as Pino's attorney, citing disagreements with
Pino over how to handle the case.

"I'm trying to find an attorney that believes in justice," Pino said.
"One that will fight for me; I feel like I'm getting hit from the
left when I'm looking right and getting hit from the right when I'm
looking left. But I'm not on a banana peel, and they won't catch me
slipping."
