JUDGE ORDERS WINDSOR DISPENSARY TO CLOSE
GREELEY - A judge has ordered the closure of a Windsor medical
marijuana dispensary that town officials say is defying a moratorium
on the businesses.
Weld County District Court Judge James Hartmann issued a written
statement Wednesday ordering the MediGrow dispensary to cease
operating in the northern Colorado town.
The decision follows last week's hearing on Windsor's request for an
injunction to close the dispensary. The town has been citing owner
Lazarus Pino fines of up to $300 every day since Dec. 17, a day after
it passed a 75-day moratorium on new marijuana dispensaries.
Pino says he opened for business before the moratorium. He has another
opportunity to argue his case in May when he goes to municipal court
to challenge the moratorium's constitutionality.
