DENVER JUDGE OVERTURNS MEDICAL POT RULING

A Denver judge has overturned a state health board ruling that narrowed
the definition of who can supply medical marijuana.

Denver District Court Judge Larry Naves said Tuesday that the order
adopted by the health board on Nov. 3 is "invalid and void."

A state health department official said she doesn't know if the ruling
will be appealed.

Medical marijuana advocates challenged the rule change in court, saying it
was made with little notice.

The board temporarily suspended its rule governing who can supply
marijuana to patients in light of a recent Appeals Court ruling. That
ruling said suppliers must do more than just provide medical marijuana to
be considered a caregiver.

Naves said he didn't see any evidence that the board considered how the
vote would affect the health of patients.
