CITY WILL RECOVER COSTS FROM GROW-OPS

The City of Nanaimo will recover costs in dealing with marijuana grow
operations and methamphetamine labs by going after landlords and
property owners.

The city spends $54,000 a year ($2,000 per grow op and $12,000 per
meth labs) cleaning up illegal operations in Nanaimo residences.

In a report to city council, bylaw services manager Randy Churchill
said grow operations and clandestine labs are a threat to the health
and safety of enforcement staff, building occupants and to those in
surrounding properties.

"These are urgent matters requiring action by the RCMP, fire
department and other city staff," he said.

"Property owners bear little of the cost other than remedial expenses,
building permit fees and water reconnection fees."

Council voted unanimously on a substance property cost recovery bylaw
Monday, holding property owners and landlords accountable and allowing
the city to recover actual costs.

Coun. Bill Holdom said he had no problem with the intent of the bylaw
but wondered if enforcement should be directed to the property owners,
when tenants are actually making the mess.

Churchill said the bulk of hydroponic grow operations take in excess
of 45 days to begin producing so the onus should be on the property
owner.

"There is ample time for property owners to spot the trouble if they
are diligent," he said.

Mayor Gary Korpan said those who harm our society should be held
accountable and a bylaw like this is years overdue.

"It comes down to the fundamental principle if you are going to cause
harm to your fellow citizens or community, you need to be held
accountable and not pawn off the responsibilty onto the backs of the
taxpayers," he said.

"If property owners or landlords are negligent in checking the
references and quality of tenants or leaseholders, they have to face a
responsibility."
