APPEAL FILED IN HOLY SMOKE CASE

Akka Annis and Paul DeFelice, the two of the Holy Smoke workers sentenced
to jail earlier this month, have filed an appeal.

According to their lawyer Donald Skogstad, DeFelice has been released from
the holding facility in Kamloops on bail until the hearing in February and
has returned to Nelson. DeFelice was sentenced to 12 months in Kamloops
Regional Correctional Facility for marijuana trafficking, something
Skogstad thought was too much. "The decision was wrong," said Skogstad. "My
clients should have been acquitted. They were given too harsh a sentence,"
he added.

Annis also does not have to serve his sentenced 40-day weekend jail time in
a Nelson holding cell, as he is also out on bail until February. At this
time, Skogstad will reargue for his clients in front for three senior
judges. "We will go to the Court Of Appeal and re-argue the case on legal
principles," said Skogstad. The two other defendants involved in the case,
Kelsey Stratas and Alan Middlemiss, will face sentencing December 23.
