Police should not be allowed to testify that the typical
heroin dealer in the San Diego area is a Hispanic male, a
state appeals court ruled Monday in overturning a drug conviction.
Such "profile" testimony "improperly invites a finding of guilt
by association," said the 4th District Court of Appeal.
The court granted a new trial to Reginaldo Castaneda, who was
convicted of possessing heroin and sentenced to nine years in
prison.
