Rep. Lamar Smith,RTexas,accused the Justice Department on Wednesday of
"evasion,"saying it is concealing information in the fatal shooting of an
18yearold goatherd(er) by a Marine along the U.S.Mexico border in Texas.

In a letter to Attorney General Janet Reno,Smith,who chairs the House
Immigration subcommittee that oversees the department's U.S. Border
Patrol,said his two month probe into the killing has been"obstructed by a
neverending series of useless referrals,unreturned telephone calls and
broken promises"to provide information.

He said the"level of stonewalling...has been egregious,"and added that "I
am disappointed at the evasion and delay by the U.S. Department of Justice."

Smith threatened to hold "multiple public hearings"this fall on the
incident.
