DRUG POLICY NIXED
TORONTO (CP) - In a decision that could have far-reaching consequences for
the workplace, an Ontario court has thrown out Imperial Oil's tough drug-
and alcohol-testing policy as discriminatory.
The court unanimously agreed with an earlier ruling that the policy relied
on stereotypes about people with disabilities or perceived disabilities,
the Ontario Human Rights Commission said yesterday. It also affirmed that
drug and alcohol dependence and abuse are handicaps under human-rights
legislation.
"It's a small victory in the legal process," said Marty Entrop, a former
alcoholic and the employee who brought the initial complaint against the
policy. In 1992, Entrop was forced to disclose his past problems with
alcohol. As a result, he was demoted from his job.
