MAN SHOT IN NV DRUG RAID LOSES CIVIL SUIT

A North Vancouver man who was shot during a police drug raid of his
home has lost a civil suit against the RCMP officer who pulled the
trigger.

David Lorne Glover was shot in the chest by Cpl. Glenn Magark on March
19, 1990, when police arrived at his doorstep to execute a warrant to
search Glover's home for drugs.

Glover sought damages from Magark for injuries caused by the gunshot
wound.

In her reasons for judgment, Madam Justice Marvyn Koenigsberg found no
evidence of reckless conduct or gross negligence on the part of Magark.

The police corporal had knocked on the door. Glover opened it and
Magark shouted "police, get down," or "police, face down on the
floor." Other officers at the door called out "police and "warrant."

Glover had a TV remote control in his hand and did not comply with the
commands. He was shot by Magark a few seconds after the police
commands were given.

Glover's case argued that Magark had acted recklessly and without
justification. In earlier trial testimony Magark had said that Glover
attacked him with the remote control.
