WOMAN, 64, FOUND GUILTY OF POSSESSING MARIJUANA
Lancaster - A 64-year-old woman who says she smoked marijuana to ease
the pain of illness was found guilty this week of a misdemeanor charge
of possessing the drug after she pleaded no contest.
Delphia Toney of Hazel Green was ordered to pay a $10 fine, plus about
$100 in court fees. She faced a maximum penalty of a $1,500 fine and
more than six months in jail. Prosecutors dropped a charge of
possessing drug paraphernalia.
She was arrested Aug. 6 after a postal inspector delivered a package
that included marijuana, the criminal complaint said.
The woman had said she smoked marijuana because she was in pain after
surgeries but suffered from a stomach condition that would have been
aggravated by normal pain killers.
Prosecutors said, however, that Toney admitted she had smoked
marijuana for about 50 years.
