DOWNEY'S LAWYER SAYS JUDGE SENTENCING ACTOR ON DRUG CHARGES ERRED

Robert Downey Jr.'s lawyers say the actor should have been released from
prison a long time ago. Attorney Robert Walters said the Malibu judge who
sentenced Downey on drug charges made legal and mathematical errors, the Los
Angeles Times reported Sunday.

Walters said Superior Court Judge Lawrence Mira did not specify whether
Downey's misdemeanor sentences would run at the same time or in a series and
didn't take into account the time Downey had already served in a drug
rehabilitation program.

Under Mira's sentence, Downey would be eligible for release Nov. 2. His
lawyers say he was eligible in February.

Downey, 34, was jailed last year after admitting during a probation hearing
that he was missing scheduled drug tests. Mira sentenced him to three years
in prison.
