HELLS ANGEL DISCRIMINATION PETITION TOSSED FOR BEING IN THE WRONG COURT
VANCOUVER - The B.C. Supreme Court has thrown out a petition from a
Hells Angels member who says he's faced discrimination because of an
Ontario court ruling.
Rick Ciarniello says he's been maligned over his membership in the
motorcycle club ever since an Ontario court declared the Hells Angels
a criminal organization.
But Justice William Ehrcke says Ciarniello was in the wrong court.
He says he doesn't have standing to deal with constitutional issues
that question the findings of an Ontario judge.
Ehrcke says Ciarniello will have to go back to the Ontario courts to
argue that his Charter rights have been infringed.
Crown lawyer Pat Riley, representing the federal attorney-general,
says the sections of the Criminal Code cited by Ciarniello don't
infringe his rights.
