3 MEN INDICTED IN WAREHOUSE POT CASE

A federal grand jury on Friday indicted three men charged with growing
4, 000 marijuana plants in a West Oakland warehouse that supporters
say was a legitimate grower of medical cannabis.

Jacek Mroz, 27, of Oakland; Jesse Nieblas, 32, of Alameda; and Mario
Pacetti, 33, of Alameda were named in a five-count indictment returned
Friday by a grand jury in Oakland. They're charged with manufacturing
marijuana, possession of marijuana with intent to sell, aiding and
abetting, and using a place for manufacturing marijuana.

The plants were discovered June 30 by California Highway Patrol
officers at a warehouse at 2638 Market St. Pacetti was not among those
arrested at the time. A no-bail warrant for Pacetti's arrest was
signed Friday by U.S. Magistrate Wayne Brazil.

Medicinal marijuana advocates criticized the CHP for calling in
federal Drug Enforcement Administration agents -- instead of Oakland
police -- and said the plants were being grown for a dispensary with a
permit from the city of Oakland.
