'NO' TO POT DISPENSARIES HOLDING
On Monday July 21 it was a joint meeting of the Fortuna City Council
and the Fortuna Development Agency. All council members were present,
with the exception of Mayor Campbell who was not feeling well that evening.
On the subject of paying the bills, City Manager Duane Rigge reported
that during this last accounting period, the City of Fortuna's bills
amounted to $519,810.22, and the Redevelopment Agency's bills were
$72,593.49. Without deliberation, the Council agreed to pay the bills.
One of the points to this meeting was to conduct another public
hearing on the proposed municipal code ordinance prohibiting the
establishment of medical marijuana dispensaries in city limits. In
this second reading of the proposed ordinance, Rigge said that the
adoption of the ordinance would "essentially prohibit" a business
founded on dispensing the plant.
City Attorney David Tranberg said that the ordinance under
consideration was essentially the same as the earlier document. "The
notion that this ordinance is addressing, is not, per se, the medical
use of marijuana. That's a bigger issue than the City of Fortuna is
willing to tackle," he said.
"This ordinance though addresses only that narrow part of the medical
marijuana situation that is dispensaries that are essentially
businesses open to the public," Tranberg added. "To the extent that
medical marijuana provides relief to patients, they can still obtain
it on their own, or grow it legally." There were no public comments
following Tranberg's report.
A motion was made to hold another reading of the ordinance and to adopt it.
