DRUG-IMPAIRED PROPOSAL WILL END UP IN COURTS
Having watched with interest how the Conservative government rammed
so-called violent crime legislation through the House, and how they
bullied the Senate, it's somewhat heartening to know that the
drug-impaired driving law is on such shaky constitutional legs.
I suspect the crafters of this bill thought we are using the United
States system, which has more leeway for "per se" declarations of impairment.
I predict this new "drug-impaired driving" law will last a few weeks,
until a senior with a prescription, a diabetic on insulin, or a legal
medical marijuana patient is charged with impaired" driving.
In the latter case, evidence will be brought forward showing that
experienced cannabis users are in fact, not impaired. Sadly, this law
will do nothing to increase public safety, and when this law is
struck down, may very well impact favourably on the truly alcohol impaired.
