MANHATTAN- REVIEW OF POLICE INCIDENT

An internal police tribunal has recommended that the Police Department take
no action against an officer who threw a police radio at a fleeing drug
suspect, who later died. In 1999, a state grand jury voted to bring no
criminal charges against the officer, Craig Yokemick, in the 1998 incident.
The man, Kenneth Banks, suffered a skull fracture and died. Mr. Banks's
family settled a wrongful-death suit against the city for $1.1 million. A
federal grand jury is investigating whether the officer violated any
criminal civil rights laws. A police administrative judge recommended on
Tuesday that Officer Yokemick be cleared. Police Commissioner Bernard B.
Kerik, who can overrule the decision, will act soon, a police official said.
