COURT REJECTS SCHOOL RANDOM DRUG TESTING
DENVER - A federal appeals court outlawed an Oklahoma school district's
random drug testing of students involved in extracurricular activities.
The 10th U.S. Circuit Court of Appeals panel ruled 2-to-1 Wednesday that
the Tecumseh School Board did not demonstrate a need to use drug-testing as
an admission requirement for all afterschool activities.
The majority ruled that the policy violates the Fourth Amendment's
protection against unreasonable searches.
The 7th and 8th U.S. Circuit Courts of Appeals have upheld similar
drug-testing policies, and the U.S. Supreme Court in 1995 upheld random
testing for student athletes.
