D.A. Shows Questionable Judgment In Testifying In North Bay Case

We count ourselves among those who support Proposition 215 and the
legalization of medicinal marijuana. But we can't let the unusual decision
by San Francisco District Attorney Terence Hallinan to testify in a Sonoma
County marijuana trial on Tuesday go unchallenged.

What was the honorable Mr. Hallinan thinking?

He of all people should know the importance of being prepared for trial --
whether he's doing the grilling or being grilled. Yet as soon as he took
the stand to testify in defense of Ken Hayes and Michael Foley, two
suppliers for a San Francisco cannabis buyers club, it was apparent he had
no real understanding of the case.

Cross-examination revealed Hallinan had never even been to the Petaluma
residence where prosecutors allege Hayes operated a 900-plant farm and sold
pot to more than just those in medical need.

It's clear Hallinan wasn't so much taking a stand Tuesday as he was pulling
a stunt.

We suggest that if the district attorney is so eager to keep up cannabis
supplies, he should tend to his own garden -- perhaps one in Golden Gate Park.
