NO SENTENCE FOR MAN FRISKED BY WHITMAN

The New Jersey Supreme Court yesterday overturned the sentence of a black
man whom Gov. Christie Whitman frisked during a 1996 drug sweep. The
court's decision was unrelated to the frisk, however, and turned on a
four-year sentence imposed on the man, Sherron Rolax, when he failed to
show up at his sentencing, thereby violating a plea agreement for an
18-month sentence. The court sent the case back to the trial judge to
determine if sentencing guidelines for no-show defendants were applied
uniformly. The Camden prosecutor said he would not appeal.
