TRENTON: RACIAL-PROFILING RULING

The New Jersey Supreme Court ruled yesterday that the New Jersey Transit
police illegally used race to stop and search a black man. The ruling
turned on whether the man, Marlon A. Maryland, was legally stopped and
searched when he was found with a bag of marijuana in 1995. He was
sentenced in 1997 to five years in prison. Lower courts said the search was
legal. But the state's highest court agreed with Mr. Maryland's lawyers.
The court's ruling overturns Mr. Maryland's sentence, but it was not
immediately clear whether he would receive a new trial or be freed.
