Soundcloud Pulling Dj Mixes For Copyright Violation?

I love soundcloud. I signed on pretty late - summer 2009.. but 2 hours of upload space and 100 download max for my DJ sets just wasn't gonna be enough for me. so last summer I upgraded to the Premium Solo package: 12 hours of upload space, unlimited downloads, plus other perks.. you get to see who is playing or downloading your tracks and where, etc etc.

fine. so I'm really happy with it overall. I think soundcloud is fucking great. so much sick music on there and it's a great way to link with other DJs and producers. but back in January soundcloud posted this on their blog ->

Q&A: Our New Content Identification System


Starting in the last few weeks we’ve turned on an automatic content identification system, similar to those used on other major media sharing sites. The system is used primarily for identifying audio that rightsholders have requested to be taken off SoundCloud. This is good news because it makes it easier for artists, labels and other content owners to control how the content they’ve created is available. And when you upload your own audio to SoundCloud, we can find out more quickly if somebody is uploading a copy to their own page without your permission.

For the vast majority of SoundCloud users, there won’t be any changes. You can keep on creating, recording and uploading original content (and any audio that you have the rights to upload) without any interruption. But we’ve already received some questions about this, so we wanted to give everyone the heads up.

In cases where users upload audio that is owned by rightsholders who have requested a takedown, we are hiding the upload entirely and sending an e-mail to explain the situation and give the user options for next steps. The e-mail will usually contain information about the rightsholder, which is in most cases a record label or publishing company. If you receive one of these e-mails and feel that the upload was flagged in error, because you actually have permission to upload the audio, there’s a simple dispute process. We’ll review the dispute, unhide the upload, and it will appear in your profile again with all stats and comments intact.

This is absolutely ridiculous! I'm a dj who uses soundcloud to share my mixes with friends and followers for their own personal enjoyment. My mix was flagged as one of the tracks has been barred by the rightsholder, who i have googled and cant find anywhere!? I bought the tune on vinyl about 10yrs ago and can't believe i can't include it or share the mix because this track is on it. The only response i've had is a suggestion to re-do the mix without this certain track on it -- which insults my own artistic integrity! I am a paid subscriber to the site and was considering upgrading for more minutes to upload more mixes but now think i'll look elsewhere!


soundcloud's advice was to re-do the mix without the track on it?? riiiight.

I've never had a problem, cuz I'm playing obscure old tracks that often usually on small underground labels, or often not on a label at all. but - for example, what if I upload an old ragga-jungle set with a Buju banton remix.. are they gonna ID his voice with that software and pull it?? I've heard peeps on [ ragga-jungle.com ] complaining about this. or if I play a D&B track that samples someone like Bjork or Everything But the Girl or Eurythmics? I reckon it must be a problem with people playing really upfront popular tracks and doing remixes of big artists for dubstep, electro etc

so I was curious.. have any DJs or producers on here had mixes pulled on soundcloud? and what alternatives to soundcloud are there that are of similar calibre?

Actually that was something someone was bitching about also, the DnB producer Cern uploaded a promo mix, and it was blocked/pulled because of the unreleased Cern tunes that it was promoting..

And things like this is why I say that the BEST site to use to host your mixes is... [ rave.ca ]

ya I put my mixes up on [ rave.ca ] too. thanks Noah =) but I also put em up on soundcloud and youtube, with track listings. and I post the soundcloud waveform/link up on at least a dozen different websites and on facebook, now that I'm finally on there.

[ rave.ca ] is awesome of course, it's a great home base. but I find I don't get many downloads or hardly any feedback from people on my mixes. people might click on the thread, but as far as comments, it's mostly tumbleweeds.

that's not just [ rave.ca ] - it's actually pretty hard to get feedback on a lot of sites, because of the sheer volume of mixes people see posted up every day. I don't really get much traffic to my profile on [ rave.ca ] but I get lots on soundcloud and youtube.

my last mix I uploaded on here has 35 downloads since January, and no comments -> [ www.rave.ca ] < - but in that same time on

and it's got 1,711 plays on my [
youtube">www.youtube.com ] channel. so I like to have a variety of different hosts to reach different audiences. I also have em up on letsmix and mixcloud, but I don't get much traffic there.

but [ rave.ca ] rocks. cuz it's on a site with lots of cool peeps that I know personally, everything is cross-referenced, it's very well-designed, I know I'll never have a problem uploading anything. and it's free, of course =)

In general you can't unless you have the artist permission or the track is distributed with a creative commons license without the non-derivative works clause... A DJ mix would be considered a derivative work.

The issue is that the artists were not compensated for the 973 downloads.. At least in the eyes of the label, 973 people got free copies of the tracks

lol =) in my case, I'm good =) those old labels were totally cool with underground mixtapes. and besides I know a lot of those cats anyway, so they definitely wouldn't have a problem with it. some of them have have listened to that mix, and they're happy to see their tracks get represented

well ya when you put it that way, I can see their point. if I'm uploading a mix of sought-after tunes in 320 or .wav, I dont want any cheeky monkeys snipping tracks out of the set. especially if the track is unreleased. so I heavily mix em and sometimes watermark em with samples.

but not every DJ is gonna want to do that.. they might start a set with a big tune and let it roll out, unmixed, for 3 minutes.. so anyone downloading that mix would essentially get a copy of the track.

but some of the rulings seem kind of arbitrary and heavy-handed. and don't seem to recognize the role of serious DJs in promoting the music. do they think smothering creative expression actually encourages people to support that label?

it reminds me of Mark Ryder and his Strictly Underground hardcore/jungle label in the 90s.. he's an amazing producer. one of the best, and he's put out shitloads of good tunes. but some of his records came with this warning:



"promoters and DJs. if you use our tracks on illegal mixtapes we will sue you to the full extent of the law"

lol! the very foundation of the hardcore jungle scene was illegal raves, underground mixtapes and pirate radio. not to mention his records were full of uncleared samples, themselves. so while it did make DJs and promoters careful not to step on his toes, it also made other fans choose not to support his label.

Posting DJ mixes is the definition of GREY AREA. It certainly counts as a derivative work in the minds of many.

Unfortunately, different artists and labels have different ideas about it.. Maybe they should let people know..

I don't disagree with this action, if Soundcloud doesn't want to get sued into oblivion, they shouldn't let people give other people's work away for free. From what I understood, Soundcloud was designed to allow artists to share their tunes, not their mixes of other people's copyrighted work.

My label in France is Sony and whenever I upload my artists music videos on youtube they pull it off, even if I own the masters and all rights to it. Its fucked up.

I discover so many new artis when listen to dj mix and the company should consider those mix as free promo instead of copyright violation.

well you're right. since I'm just DJ I never really thought about that, but you're right - Soundcloud was primarily geared towards producers. that said, I still love using soundcloud and I certainly don't anticipate any problems.. for underground jungle the labels don't mind.. I know these dudes.. they give me tunes to play, so obviously they want me to put them on a mix. so long as I'm not selling a mix CD in HMV with old Moving Shadow or Goldie tunes on it, its not an issue.

i think the soundcloud thing is only an issue once you get into more popular genres

crazy. see that's the thing. if people click the link in my original post... some people are getting mixes pulled even though no complaint was actually filed by the copyright holder. some kind of glitch in the software

well that's what I think too... a good DJ is can sell so many records for an artist if they do a clever mix with one of their tracks.. so many times that happened with me, back in the day. a really good DJ would put out a mix and they'd put it together so well I wound up tracking down every single record on the mix. the DJ turned me on to tracks that i might have overlooked if they were just on a compilation, unmixed.

ideally that's what DJs should be doing.. but one problem is nowadays so many people fancy themselves DJs, and might not have even paid for the track in the mix... as Scotty P said, a huge grey area.
