The difference, though, is that he's using these as "trailers" for his movie; people doing that all over youtube are just doing it for fun, for practice, to learn, etc..

But he's using these videos as promotional material, and that means that there are laws that he has to follow, and one of those laws is that anyone that appears in any of his material has to give consent, either recorded on cam before talking or written on paper, and any event/gathering that he uses in his movie/trailer has to have an announcement/disclaimer that the event is being recorded so that people who don't want to appear on camera can chose not to go to said party/event.

The *SECOND* he decided that he was going to make a movie, he had to start asking EVERYONE he filmed for their consent, no exception, which they are also legaly allowed to revoke at ANY time and he MUST comply, and he had to start having the consent of party organizers to film their parties as well as warn everyone going to the party that they were being filmed for a movie/documentary.

As it stands, EVERYONE that is in every single crowd shot he filmed has the right to sue him or have him cut out a scene that they're visible in, even if they're not identifiable and you only see the shoe of one of them in the corner of the film.

As long as he is in public places which most of these parties were in he has the right to film people. And as long as he does not make money I'm pretty sure he can do whatever he wants with the footage.

That's how most documentaries work. That's also why it's legal to distribute most documentaries out there for free. MVGROUP is a good example of that.

If he made money from the movie, then I would have to agree he would need people's permissions... Anyways I'm sure lot of people are tired of him filming them all the time. But I have not seen him film people in a couple of months. He decided he had enough footage like 2 months ago and from what I can see didn't record much. And even if he does, I see other people doing it also.

Anyways. I think what he is doing was a good and fun project for him. I hope something good comes of it.

Mickos, for sure he didn't have the right to get mad over the flyer thing. That was hilarious... But you guys always flock to each other. If you see him just turn the other way and I keep telling him to do the same thing whenever I see him around and you. Not that anyone ever listens to me.

Being "pretty sure" and knowing the law are two different things.

In Quebec, the Quebec Human Rights Code grants all humans the right to their private life. For photography, this broadly-worded right allows each individual person in Quebec control over the use of their image (meaning, a photo of them).

This was recently upheld by the Supreme Court of Canada in a case where a photographer published a photo of an individual in public, without the subject's permission. The image was nothing special, it was taken from a public place of a person in public, and did not injure their reputation. However, the Supreme Court of Canada said that the photographer should not have published the photo without the permission of the person photographed, and ruled in the favor of the subject of the photo. They did note that there are exceptions for newsworthy events, people who are in the public eye, like politicians or celebrities, or if the person was incidental to the photo, and not the main subject(s).

If everyone followed all the rules we have all the time life would suck. It's almost as if rules were meant to be broken. Anyways I for one am looking forward to seeing his project and then I'll make my own decision if it's a good thing or not.

So that's the nerve of the problem, innit? Is Antonino making a documentary about the rave scene, or the [ ] people"?

Cuz even then, some people ask for their faces to be blurred in group shots, something which, as far as I know, is usually granted (for fear of lawsuits, notably).

As was stated before, notably (and eloquently) by DrNyarlatothep, this could pretty well lead to a defamation lawsuit because statements were coerced, recorded and edited (most probably, and especially, under influence).

Hell, if the NFB funded this thing, I kinda hope it does all the more.

One more thought: calling this a "documentary" is a farce, IMHO. Precisely because there are ethics (read: rules) to be followed when making one.

This is obviously shot from Antonino's (subjective) POV. And says a lot about his character, even if I don't know him that well personally.

Just more reason for me not to get close to this guy. Starting with not getting my picture taken with him
