Alright bitches, I've got a question...

I'm filling out some forms for an employer and they're asking if I've been convicted of a criminal offence for which a pardon has not be granted.

Now, I was arrested and (pleaded guilty) for acts of Mischief Art, once in 2004, and again in early 2008. What I would like to know, do these kinds of charges remain on my criminal record, and should I answer YES to my employers question?

As it stands, I am planning on answering YES.

(I would have called the Municipal Court, but they're closed.)

if you were charged and pleaded guilty they will know.

say yes,but say its cause you do art in places that arent sanctioned and you get fines and detainment on occassion. its art .not actual crime im sure they will understand.

can't you just stop by a police station and they can do an inquiry? otherwise I would suggest looking up your court documents and confirming whether or not you were charged with "criminal" or "misdemeanor" charges/// You could also call legal aid? Or, if you've ever tried leaving canadian soil, thats a pretty good way to find out if you have a criminal record, cause they won't let you leave////

ofcourse, personally, I would think you dont have one... but I'm not a lawyer///

hehe, well I have absolutely no intentions on lying what-so-ever. I have a better chance of being refused for saying NO, than saying YES.

I've left the country a handful of times, and if im not mistaken the charges were considered a msedemeanor.

If anyone has some kind of online guide that I can read up, that would help.
If not, I'll just wait until tomorrow and call the courts/legal aid.

I say be honest, cause if you lie than there's always the possibility that your employer would find out and then you would be in some serious shit. I know it's a horribly lame clichè but honesty is the best policy...most of the time :P

might I add, for fact, that in my experience, employers only care about serious crimes, they don't give a shit about the rest... (ie fraud, murder, grand theft, larsony, gangsterism)

I had a warrant out for my arrest for 4-years (from the time I was arrested in 2004), and I left the country 5-times. I even managed to delay a court date so I go to a wedding in France. I think you should be OK.

what did u do to get convicted 2ce?

You get a criminal record for being convicted for anything criminal. If something is illegal, but has been decriminalized (like speeding or spitting), you would no a criminal record. I believe acts of Mischief are indeed criminal, and by pleading guilty, you would get a record. But im not 100% sure.

Mischief Art aka Bombing aka Graffiti.

Either way, I'm going to try and contact my lawyer about it tomorrow and see what he has to say about it.

The more and more I think about it, I feel that by checking the little Yes box, and describing my offenses would be in my best interest. If they respond "Thanks, but no thanks" then that's just another consequence of my actions.

You should definitely go to the police station to get that record verified.
I though I had one but ended up clean cause my offense was considered "civile" instead of criminal
It only takes 10 minutes to get a paper that proves your record is clean
And if it's not.. well at least you'll know ;P

I don't think there's any such charge as "Mischief Art"
I think it just falls under mischief, so I would make sure
that's all in order before applying at ze bank, my suggestion.
