So I'm in a pickle.

I moved into my place with my girlfriend last July, the landlord seemed awesome at first.
Nice looking guy maybe in his early 40's, ex jazz bassist bohemian kinda lookin dude,
but straight laced none-the-less. He looks like he means business in other words.
He was offering us a great place for cheap and he seemed to like us. He knows we're somewhat
young but not stupid & naive and definitely not immature in person. We signed a lease agreement
and separate contract stating all his requirements for living here. We have adhered to his every
standard, maybe like 2 bounced rent checks that we always covered and never payed later than the 5th.
now because of the bounced checks, he doesn't want them anymore, he wants cash. We owed him back rent
from March (250$) that we replaced promptly on April 3rd. He lives in Rimouski or some shit so he
doesn't always have time to come pick up the rent personally, we understand and put the check
down in his mailbox in the empty apartment downstairs. This time my gf put the 250$ back rent in the
mailbox and that was that. We received a call from him yesterday saying that we still owe him the 250$.
I was very confused considering I thought my gf had put it in the mailbox the day after he asked for it (April 3rd).
He's saying there was a note saying that we would pay him at a later date and of course NO MONEY! Now he's
basically telling me my gf is a liar and we're irresponsible. I then remembered, this motherfucker hasn't been
giving us receipts for our stay here! What if he's just out to build up a court case on two unsuspecting kids
with good intentions!? He knows we smoke herb here, so maybe he has a grudge against us for that, seeing how
it's illegal maybe our say is void!? But he did NOT include a smoking rule in the lease OR personal contract.
And the neighbors downstairs smoke a pack a day. So it's not about smoke, then what the fuck is it about!?
And where the fuck is the 250$ since "He's the only person with access to the apartment downstairs" ??
So I'm really fucking confused right now. The voice of reason in my head has taken a vacation and I'm trippin, HALP!

Building a court case ? Where is this note he claims he has ?

Indeed, you should ask for receipts ( then again, I shouldn't talk, I don't get them either ) or, at least, keep a track of ALL CHECKS YOU SENT HIM and check when they get cashed in by the guy.

If he's being goofy about his landlording duties, you shouldn't be held accountable for.

There are a lot of people out there that purchase buildings and apartment complexes and don't know shit about landlording or just think they got a knack for it. More often than enough, they fail at that.

And you are allowed to smoke in your apartment. If you keep your place clean, he can't come back to you on this. It's not like you've got 15 cats using the living room carpet as a litterbox.

Yeh, there was a note put in with the 250$ that he claims only says "Sorry I will pay you next week"

I guess the only thing I'm sketched about is the missing 250$, but should I care? He says he doesn't mind
waiting for me to make it again, but that's where I find his attitude a bit sketchy, the money was put down there.
I know it was. So what's stopping him from just fucking me over entirely?

Call your bank ASAP and ask for check transactions. They keep all that info. If the 250$ was under his name and he cashed it... there you go.

I've had my share of bad landlords.

If I were to screw someone over, I would ask them to pay me cash so that all recorded check transactions would be impossible to trace.

The fact he's unable to come pickup a check because he lives far but is able to move his ass for cash seems totally absurd to me.

Since you're entirely sure your GF did put the money in the box, tell him you have no intention in re-paying him the 250$ since he's the only one that has access to it. Would be good to ask him for your past receipts too. Protecting your ass is the only way you're going to save yourself a trip to the Small Claims court.

PS: Oh... and if I were the judge in the matter, I wouldn't really tend to believe the guy who had two rent checks bounce and hadn't payed 250$ in late rent.

Where I used to live before, I had to pay cash ( it was rather sketchy, they wouldn't accept anything but cash. Then again, my building was full of hippies, the concept of banking and accurate budgeting seems to elude these people ) but I ALWAYS had a receipt in return.

Ask yours today, Host1.

One thing you could also ask is for him to open up an account with the bank you deal with. Say, you have Royal Bank, he could open an account SPECIFICALLY for your rent. Come rent time, you transfer the amount from YOUR account to his " rent " RB account using the bank's website so he won't have to drive to Mtl, he could just to go to his local ATM, withdraw the cash, BOOM. Done.

Not only that but your banking website will give you an AUTHORISATION CODE that you, for the love of God, copy-paste every month in an Excel sheet with the date and time plus the code that you save and backup from time to time.

I did this with a previous landlord and it worked like a charm.



If your landlord REFUSES this option and/or to give you receipts for your cash, watch out for a scam.

payed the money in cash anyways haha

I dunno, he's coming to pick up the rent in an hour.

Take that time to do a receipt, print it on your printer and MAKE HIM SIGN THAT SHIT TOMORROW. I can't stress this enough, especially if it's cold hard cash.


I guess he's ok on crack for tonight, he'll need his money tomorrow morning though.

As someone who has fucked over their landlord 3 times in 3 years, and as someone who has worked for property management companies...heres my advice: dont keep anything valuable in ur apartment, and then dont do shit about it.

1) Its your landlords fault. If you have a witness (ie anyone else in the appartment who also pays in cash), the court case becomes here-say and he won't win. You also might have proof of 250$ withdrawls every month on ur account-statement which also stregthens ur case

2) Your landlord won't sue you for anything less than 1000 dollars. Just dont give the suite excessive wear and tear, and its not worth his time. If he doesn't win in court he loses time and the money spent on the court case (he has to pay all court fees). Usually at around 1000 dollars it becomes worth his time to sue you. 250$ might be a lot to you, but its dick all to the landlord

3) If the landlord is retributive, he might try and get even by stealing some of your shit a couple days before move out. This is illegal. But the landlord knows you wont take any legal recourse against him or have time to do serious damage to the suite.

4) A bailiff is way too pricey an option to fight over 250$.

If I were you Id simply meet with him, have no money in hand. And tell him what happened. Also tell him you have to go meet your gf for coffee in 15 minutes. Let him know that its not your fault, and he might want to think about changing the locks. He might threaten you, or tell you your fault. Don't disrespect him. If he threatens you, they're empty threats. Don't blatently call him on it. But explain to him that you think your right, and thus are willing to go to court over it. He might get pissed off, he might repeat his threats. Whatever...just keep repeating that you did what he told you to, and that your sorry hes out 250$, that he might want to think about changing the locks, and that you don't mind going to court. After 15 minutes, if hes still arguing, remind him you have to go for coffee, and that your not going to repay the rent that you have already paid. Suggest a different payment for paying the rent (for instance direct deposit over the internet).

Having been in such situations from both sides, I can tell you with 95% confidence that he wont take you to court. But that probability changes if you really piss him off. So just just be firm, but respectful.

well it's not that crazy of a situation, it's not a squaller shack, I'm just afraid he's too straight laced
to have me as a tenant since I smoke pot, and I hope he isn't taking advantage of that 250$ that went missing.
If it really did, I'll replace I don't give a fuck, just don't try to get me turfed out for not having it right away, ya know? That's all I'm hoping for, he gets payed in crisp 100$ bills, so what the fuck does he have a reason to complain for? And how did this money go missing?

And I'm guessing these crisp bills came from the bank, so you got reasonable doubt there.

And it's indeed possible someone else has access to that apartment (previous "concierge" type that he might not even know about? 'cuz I'm guessing he didn't "build" the place, or "own" it since).

And yeah, you could try and mutually find a third way of paying rent. Tell him you're not comfortable paying cash anymore. AFAIK, he CAN'T request it without a receipt. Tell him at the very least you'd contact him if you thought the money wouldn't be in your account exactly on the 1st. But seriously, tell him he needs to come and pick it up himself (or through a 'legal' representative, none of this 'dropping it' somewhere, sounds like a bad ransom movie)

Did he even provide you with property tax receipts, assuming you've been there long enough? ...Fuck I hate sketchy landlords.

This guy made me sign a paper stating that he warned me about the state of my apartment, there
we're too many, get this, PUBLI SACS in my doorway! Those things stack up like fuckin mad in the
winter! HAHA! What does he expect!? Anyways, I make sure I take out the money on time every time
so you're right, the reasonable doubt is there, because of ALL the transactions that are available.

I spoke with him on the phone and very politely told him i'd like to give him the money in person
and talk about getting a wire transfer account going on, and asked him for some kind of receipt.
He sounded quite open to it and he's showing up at noon.
