2 weeks ago I got a speeding ticket for $225 for which I was guilty, but the cop wrote the wrong date on the ticket. It occured on the 23rd and he wrote the 22nd.
Does anyone know legally speaking, if this is grounds for contesting a ticket.
possible arguments:
1) a speeding ticket is like a contract, if any part is incorrect, it is technically void.
2) If the cop got the date wrong, what else did he get wrong?
3) I was issued a ticket for something that never happened. I wasn't even there on the 22nd. or something...

I have already recieved several opinions on the subject..... I'm looking more for someone with experience in a similar situation or someone who knows about the legal system.
thanks

If you've got a clean alibi for the 22nd, there's nothing really keeping you from contesting it

My brother got around having possession of 2ounces of pot with that kind of error.

donlouis: I also know someone who got also off of a possession charge because of an error on the court appearence notice. That speeding ticket should be easy very to contest, it's almost a guaranteed win situation cause you weren't where the ticket claims you were on the date that's written on it besides which the double jeopardy rule prevents cops from charging you twice for the same offense.
I'm feeling you up right now..

i had a ticket for 545$ for speeding on the high way. the cop wrote 2 completely different times, the wrong highway, and he also pulled me over a second time to correct the fact that the time was wrong. i contested it, which took over 2 years to get a court date, but thats besides the point.

anyways, i was contesting on the fact that there was no way i was on that other highway just because that intersection never existed. but as soon as my case was braught up, the first thing the prosecuter said to the judge was that she noticed a mistake on the ticket but that shouldnt affect the ruling based on the fact that they caught me with a radar.

so long story short, i lost and have to pay 660$ now... 120$ court fee (not 10$ thierry)
so yes you can contest it, and you wont have to waste any money right now, but once you lose say 2 years from now, you have to pay at least 75-100$ more and only once that is payed, will you start the 2 years without your full points.

just my 2 cents, do what you want, but in two years from now you will have your points back if you just pay it now.

and murdock_rock: if he doesent show for the first date, the court is allowed to change dates at least 2 times, maybe 3 which give the cop a chance to actually have a day off, and will show on one of he days.

i thoughjust like every single one of you, i though i was in the ight, and there would be no way that i was going to lose. the fact of the matter is that he caught you on radar, and thats what the judge will say.
I'm feeling like drinking more right now..

That's no longer true. I got a speeding ticket and nearly lost my license, cop wasn't there but they still went forward.

You have nothing to lose if you contest though, they wont charge you more and you get to delay the ticket a full year since the court date is always more than 12 months off.

I got my ticket reduced cause the cop told me i was driving 112kph then wrote 116kph on the ticket (which just happens to be 45kph over the speed limit which makes it 5 demerit points vs. 2).
I'm feeling newsique.com right now..

im pretty sure if you contest and lose, that also counts as contempt (sp) of court, which means further fines. Cops dont need to show up for it either.
I'm feeling not water soluble right now..
