much as I hate to be the spoilsport:
[ laws.justice.gc.ca ] 3-1-a: For the purposes of this Act, “copyright”, in relation to a work, means the sole right to produce or reproduce the work or any substantial part thereof in any material form whatever, to perform the work or any substantial part thereof in public or, if the work is unpublished, to publish the work or any substantial part thereof, and includes the sole right
(a) to produce, reproduce, perform or publish any translation of the work which, in plain english, boils down to: [ en.wikipedia.org ] Exclusive rights
Several exclusive rights typically attach to the holder of a copyright: to produce copies or reproductions of the work and to sell those copies (mechanical rights; including, sometimes, electronic copies: distribution rights) (...) ***to create derivative works (works that adapt the original work)*** <----- (...) ***to sell or assign these rights to others*** <----- The phrase "exclusive right" means that ***only the copyright holder is free to exercise those rights, and others are prohibited from using the work without the holders permission.***** (...) The right to adapt a work means to transform the way in which the work is expressed. Examples include developing a stage play or film script from a novel, translating a short story, and making a new arrangement of a musical work. So, no, despite what you think Noah, it IS actuall illegal to make 'his own version' of the painting if they weren't given express permission by the original artist (in the same way that you're not allowed to make/release a remix without permission from the copyright owners, which is why most remixes are bootlegs/white-label/Unknown Artist productions)

Screwhead: I'm not sure those rules apply to art... We should ask someone... I don't think it does... If I draw a picture of a house on a lake, I'm sure you can draw a picture of a house on a lake without problems... As long as they are not duplicates, there is nothing wrong with that.

They apply to anything that can be copyrighted as an artistic expression: paintings, drawings, movies, plays, novels, articles.. Technically, us reposting the content of news articles and not just linking to them is breaking copyright law, as is your server downloading/saving pictures linked from other sites. If someone wanted to be a dick about it, they could very much sue you for each individual image you're re-hosting without permission.
For your house on a lake example... If you draw a picture of a house on a lake, and I go to the same place and draw the same house on a lake, that's not really a problem. If you publish/copyright the drawing, then yes, it would be illegal for me to 're-create' the drawing, even if it's not based on your drawing specifically and I just happen to sit at the same spot and find it nice enough to draw.

I think you would get laughed out of court if you went after someone who drew the same house on a lake but totally differently cause you claim you own that image. You have to stop looking on American law. It works differently here in Canada... That is why we don't sue each other like crazy, cause we can't.

Nah.
